BALTIC Contemporary Visual Arts Trading Limited (“BALTIC”) is a wholly owned trading company of BALTIC Flour Mills Visual Arts Trust. BALTIC Contemporary Visual Arts Trading Limited is a company registered in England and Wales under number 4345367 whose registered office is at Gateshead Quays, South Shore Road, Gateshead, NE8 3BA. VAT Reg. No: 790 0716 32.
The following terms and conditions will apply between yourself and BALTIC Contemporary Visual Arts Trading Limited for the sale and purchase of the items contained in your basket, and its subsequent delivery. These terms and conditions of sales do not affect your statutory rights (under governing law and Jurisdiction).
All of our profits from this sale go to supporting the work of the Gallery.

Availability of Goods and Prices
All prices indicated for products are in Pounds Sterling, inclusive of VAT (where applicable) at the current rates and are exclusive of delivery charges. The total cost of your order is the price of the products ordered plus VAT and delivery charges as set out in the payment section of the Website. Prices of some goods may differ from those in the physical shop at BALTIC Centre for Contemporary Art.
BALTIC attempts to be as accurate as possible when describing products on the Website and to ensure that product photography is clear and accurate; however, to the extent permitted by applicable law, we do not warrant that product descriptions, colours or other content available on the Website are accurate, complete, reliable, current, or error-free.
BALTIC aims to ensure that the pricing of products on the web pages is correct at all times, however, the Website may not accurately reflect the correct details at the moment at which you place your order. BALTIC reserves the right to change prices or to withdraw an item from sale without prior notice.
We aim to deliver goods within 3-5 working days in the UK, within 7 to 14 days for European destinations and within 12 to 24 days for the rest of the world. If BALTIC are unable to deliver the goods that you have ordered, BALTIC will inform you by email at the address given on your order form.
Acceptance of Orders
All orders are subject to acceptance and product availability. Acceptance of the order and the completion of the contract between yourself and BALTIC will take place when we have dispatched the goods you have ordered, and received payment. We may choose not to accept your order; if an item is out of stock, if we are unable to obtain authorisation for your payment or if we identify a product or pricing error. We reserve the right to reject any offer to purchase by you at any time.
Acknowledgement of Order
When you have completed your order you will be sent an email confirming your order. It will state what the products are, the cost (including VAT and P&P) and delivery and invoice details. If your order has been unsuccessful you will be made aware of the reason for this and possible explanations. If we are unable to fulfil your order following our order acknowledgement, we will also contact you by email advising you of this.
Our Contract
A legally binding contract between you and BALTIC will be formed when we send you the email confirming that we have dispatched the product(s) to you. This email represents our legal acceptance of the offer you made to purchase the product(s) when you completed your order. If we confirm to you that not all the products you have ordered have been dispatched, those product(s) that have not been dispatched will not form part of our contract with you. In the event of any change e.g. in price or expected delivery date between completion of your order and contract formation, we shall inform you and you shall at that point have the right to either (i) accept such change (in which case your email reply will represent a new offer which we will accept upon notification of dispatch) or (ii) reject such change (in which case your email reply will represent a withdrawal of your order, or the relevant part of your order as the case may be).
Payment
All credit and debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, your order will not be accepted and BALTIC will not be liable for any delay or non-delivery.
Duties and Taxes
You will be liable for all duties or levies payable at any foreign port as a result of delivery of goods outside of the United Kingdom. It is your responsibility to arrange payment for any such payments and you shall not be entitled to cancel your order on the basis of unforeseen duties or levies.
Acceptance of Delivery
While BALTIC takes every precaution to ensure all deliveries reach you in good condition, we can not accept responsibility for any damage sustained once a product has arrives at the delivery address. Goods should be inspected upon delivery and any goods that arrive in an obviously damaged condition should not be accepted, this is especially important when goods are being delivered to a business address and not being signed for directly.
Returns Policy
Your statutory rights as a consumer are not affected if, for any reason, you wish to return a product bought from BALTIC Shop.
If you are not satisfied with a product, please notify us within 7 days of the delivery date and return the goods to: BALTIC Centre for Contemporary Art / Shop, Gateshead Quays, South Shore Road, Gateshead, NE8 3BA, UK. Items will be refunded or exchanged providing that you do not use the item; it is in the same condition as when you first bought it; and, you have taken reasonable care to ensure that any item is returned to us safely and not damaged in transit. Post and package costs are non refundable and we are not held responsible for returns that do not reach us.
Any claim by you in respect of any shortages and/or defects in the goods must be notified to us by you within 7 days of the delivery date, stating the nature of the shortage/defect and quoting the invoice number, failure to notify us will deem you to have accepted the goods. Where you make a valid claim in respect of any shortages or defects and we are liable for the claim, we will make up the shortages or replace the goods free of charge, or refund the price of the goods in question to you. In addition for defective goods we will refund you reasonable costs incurred for postage of the goods, but we shall have no further liability to you. If you do not notify BALTIC accordingly, BALTIC shall have no liability for any defects and you shall be bound to pay for the goods. Your statutory rights as a consumer are not affected.
Digital Gift Vouchers
Gift vouchers and cards are not redeemable for cash, are non-transferable and valid for one year from the date of issue. They can be used only at Baltic Online Shop and not in the physical Baltic Shop.
You cannot use a gift certificate to purchase another gift certificate.
The gift certificate has a cash redemption value of 0.001p and is not transferable or assignable.
Gift certificates cannot be cancelled by the purchaser of the gift certificate once they have been redeemed in part or in full and if the order exceeds the amount of the gift certificate, the balance must be paid by an alternative method.
Baltic Online Shop terms and conditions apply to all purchases except where they conflict with these terms and conditions.
If you cancel an order for any item you have purchased by redeeming your gift card, we will issue you a new gift certificate for that amount. If you redeemed your gift certificate in part payment of any item, you have the right to request a cash refund in respect of the amount you paid using your credit/debit card.
If the gift card is refunded, the voucher code will become invalid immediately.
Your Undertakings and Warranties
You warrant that the information given on your order form is complete and accurate. By using the Website, you agree to keep your password and account details confidential, and to take all reasonable measures to prevent unauthorised access to your account. You are responsible for all actions that occur in relation to your account.
Validity
By signing up for an account or ordering a product from the website you agree to accept and abide by these terms and conditions. The terms and conditions are subject to change at any time. It is your responsibility to check the terms and conditions regularly (particularly before making any purchase) in case there are any changes.
Limitation of Liability
Although we take every care to ensure accuracy, we make no warranties as to the accuracy of the information we place on our web pages. The extent of our liability for any breach of these terms and conditions shall be limited to the value of the goods ordered by you in the relevant transaction, however nothing in these terms and conditions shall exclude or limit BALTIC's liability for death or personal injury as a result of BALTIC's negligence.
Invalidity of Terms and Conditions
If for any reason part of these terms and conditions is unenforceable; the validity of the remaining terms and conditions shall not be affected.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with English Law and you agree to submit to the exclusive jurisdiction of the English courts.
You accept responsibility for ensuring that any product purchased from BALTIC conform to the governing law(s) of any country that you have that product delivered to.
Data Protection
BALTIC (and its Parent company) will take all reasonable precautions to protect your personal data. We will never make your personal details available to other companies for any purpose.
